Democrats Launch Last-Ditch Effort to Kill NFA Tax Repeal Zion Patriot, June 30, 2025June 30, 2025 BREAKING: Gun Owners of America is reporting that Democrats in the Senate plan to raise a point of order tonight in a last-ditch effort against the provision in H.R. 1 that repeals the $200 NFA tax stamp for suppressors, short-barreled rifles, short-barreled shotguns, and AOWs. What is a Point of Order? A point of order is a formal objection claiming a section of a bill violates Senate rules, specifically the Byrd Rule, which limits what can be included in reconciliation bills. Didn’t This Survive the Byrd Bath Already? Yes—the Parliamentarian has already ruled that the provision could remain in the bill. But under Senate procedure, any Senator can still force a vote by raising a point of order on the floor. What Happens Next? The Parliamentarian will again give an advisory ruling. If the Parliamentarian advises that the provision violates the Byrd Rule, the Presiding Officer will sustain the point of order, and the provision will be automatically stripped from the bill unless 60 Senators vote to waive the objection. (This would contradict her earlier ruling on the matter.) If the Parliamentarian says it does not violate, Democrats can try to overrule that decision with 60 votes (highly unlikely). Republican leadership in the Senate can choose to ignore the Parliamentarian’s ruling or fire the Parliamentarian, though this is rare.
