Under the newly enacted law: ✅ The $200 transfer and manufacturing taxes on suppressors, short-barreled rifles (SBRs), short-barreled shotguns (SBSs), and “Any Other Weapons” (AOWs) will be reduced to $0. ✅ The tax on machine guns and destructive devices remains in place for now. ✅ Form 1/Form 4 will still be required with ATF approval. When does this take effect? The language specifies: “The amendments made by this section shall apply to calendar quarters beginning more than 90 days after the date of enactment.” That means the $0 tax will be effective January 1, 2026, unless Congress passes clarifying technical corrections sooner. Between now and then, the $200 tax remains in place, though litigation is already underway that could speed up relief. ⚖️ Lawsuits Incoming Gun Owners of America has already announced they were preparing a “One Big Beautiful Lawsuit” challenging the NFA’s registration provisions. Other groups, including the Firearms Policy Coalition (FPC), Second Amendment Foundation (SAF), American Suppressor Association (ASA), and the NRA have confirmed plans to file their own cases. Their argument is simple: Without a tax, the NFA becomes pure regulation—a direct violation of Supreme Court precedent requiring taxes to be revenue measures rather than mere regulatory tools. This is the legal vulnerability many observers have called a “constitutional time bomb.” 🔹 Why This Matters Today’s signing represents a once unthinkable milestone in the fight to dismantle the NFA. For nearly 90 years, the federal government has used a tax scheme to discourage and intimidate lawful Americans from owning common firearms and accessories. While this bill does not repeal the NFA in full—machine guns and destructive devies remain regulated and taxed—it sets the strongest foundation yet to challenge the entire framework in court. Critically, if the NFA tax had merely been lowered instead of eliminated, future Congresses could have easily raised it again. But now, the courts may be forced to confront whether the entire registry can legally stand without any revenue justification. 🎯 The Long Game: Complete Repeal Though this is a major victory for the Second Amendment community, the fight isn’t over. Until the NFA is fully repealed there remains a constant risk that a future anti-gun majority will: Restore the $200 tax (or index it for inflation). Expand the NFA to include AR-15s, magazines, or other semi-automatic firearms. Impose new registration schemes. Only a complete dismantling of the NFA can prevent this. Without the grassroots movement—gun owners calling, emailing, and posting to their representatives on X—this would never have been added to the One Big Beautiful Bill. We need to vote for strong 2A representatives in Congress. Staying home only guarantees the taxes will be added back in the next time the democrats take control. Even if we got the full text of the HPA and SHORT Acts added to the bill, we still would be facing this risk. What Congress giveth, Congress can taketh away. The GOP is not perfect, but at least they are not actively seeking to remove our 2A rights like the Democrats. Rather than stay home, get active, seek out people that will stand strong for the 2A and help get them in office and replace the Democrats and RINOs.
