Defending the Second Amendment

One Big Beautiful Bill Passes House 218–214: NFA Tax Repeal Heads to Trump’s Desk

Zion Patriot, July 3, 2025July 3, 2025

In a historic vote, the House of Representatives has passed the Senate’s One Big Beautiful Bill (OBBB) by a narrow margin of 218–214, sending it to President Trump’s desk for signature.

The final vote came after days of procedural brinkmanship, hours-long speeches—including a marathon filibuster by Minority Leader Hakeem Jeffries—and intense behind-the-scenes negotiations.

✅ What’s In the Bill?

Among its many provisions, the most significant for Second Amendment supporters is:

  • Repeal of the $200 National Firearms Act tax on suppressors, short-barreled rifles (SBRs), short-barreled shotguns (SBSs), and Any Other Weapons (AOWs).

The registration requirements for these items remain intact for now, but removing the tax guts the NFA’s original justification as a revenue measure—paving the way for new legal challenges.

🎤 Rep. Andrew Clyde’s Statement

Rep. Andrew Clyde, who offered an amendment to repeal NFA registration entirely, released a statement explaining why he ultimately voted YES despite his amendment being blocked:

“While the current bill removes NFA taxes on suppressors and short-barreled firearms, it falls short of eliminating the registration of the tax because the unelected Senate parliamentarian erroneously deemed the provision violated the Byrd Rule.

I initially made it known that I would vote against the rule, hoping to have the opportunity to amend it to restore our Second Amendment freedoms.

When additional 2A changes were not obtainable, I modified my vote… to advance historic tax cuts, spending cuts, border security, job creation, and massive deregulation, as well as the removal of the draconian NFA’s foundation by eliminating the unconstitutional taxation on suppressors and short-barreled firearms.

Bottom line, we need more pro-2A champions in Congress, not just anti-gun control Republicans… I will keep fighting through all avenues—pushing legislative solutions, advocating for executive actions, and supporting challenges in court—until the 91-year-old infringement of NFA registration is gone for good.”

Rep. Clyde confirmed he discussed this issue directly with President Trump at the White House, and he pledged to continue pressing for full repeal.

🏛️ Gun Owners of America: Litigation Already Planned

Shortly before the bill passed, Gun Owners of America (GOA) posted that they are already preparing litigation to challenge the remaining registration mandates.

UPDATE: The NRA, SAF, FPC and ASA have also posted that they are doing the same.

With the NFA tax repealed but registration still intact, the legal battlefield is now set for what could be the most consequential 2A court fight in decades.

🚨 What Happens Next?

  • President Trump is expected to sign the bill before July 4, fulfilling a major campaign promise.
  • Once signed, the $0 tax on NFA items will take effect within 90 days of the signing of the bill.
  • Court challenges are anticipated almost immediately.
  • Gun owners should watch for ATF guidance on how applications and Form 1 / Form 4 processes will adapt to the elimination of the tax.

🎯 The Bottom Line

This is a massive symbolic and practical win for gun rights, but not the endgame:

✅ No more $200 tax for most NFA items.

❌ Registration still remains.

👉 The real fight to end NFA registration and restore full 2A rights moves to the courts.

Honestly, this opens the door to kill the NFA altogether, but we must act fast as the next time Democrats take control they can not only add these taxes back in, but expand them to include ARs, Magazines and semi auto pistols and rifles as well as increase the tax to inflation adjusted numbers with a provision to tie it to the inflation rate.

Stay tuned here for updates.
